Privacy Policy for Sidelined

Thank you for choosing Sidelined LLC ("Sidelined," "we," "us," or "our"). This Privacy Policy explains how we collect, use, disclose, share and protect your personal information that we receive when you use our mobile applications on the iOS, Android or other platforms, our website or our other services (the "Services").

This Privacy Policy does not apply to information that you provide to or is collected by any third party, including other apps, websites, or content that may link to or be accessible from or through our Services (see Third Party Integrations). These third parties have their own privacy policies, which we encourage you to read before providing information on or through any third-party app or website.

By installing the Sidelined  mobile application or interacting with our website or other Services, or providing us with your information, you acknowledge and agree to the practices described below. This Privacy Policy may change from time to time (see Changes to this Privacy Policy). Your continued use of the Service App after we revise this policy means you accept those changes, so please check this Privacy Policy periodically for updates.

  

1. Information We Collect

We collect or process the following types of information from or about you when you download, create an account, or use the Services:

A. Information You Provide Directly

  • Account      Details: Such as your full name, email address, phone number, password,      date of birth, username, and login password.
  • Profile      Information: Such as your photos, athletic/medical credentials, biography,      location, and certifications.
  • User      Content: Such as your posts, comments, media uploads, direct messages, and      forum interactions, or if you send us direct emails or other      correspondence.

Please note that the User Content you post for publication or display on public areas of the Services are posted and transmitted to others at your own risk. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Content. Therefore, we cannot and do not guarantee that your User Content will not be viewed by unauthorized persons.

B. Information Collected Automatically 

As you navigate through and interact with the Services, including when you download, access, or use the Services, we may use automatic data collection technologies to collect certain information about your device and your browsing and usage activity and patterns, including: 

  • Device      Information: Such as your IP address, OS type, device model, browser type,      and unique device identifiers.
  • Usage      Data for our Mobile Application or Other Services: Such as your mobile      application usage logs, screen views, session length, and crash reports.

C. Cookies and Similar Tracking Technologies

We may use cookies, or similar tracking technologies to collect information about your activities over time and across third-party websites or applications, or other online services (behavioral tracking), as well for certain other things, such as the following: 

  • Analytics      (e.g., Google Analytics for Firebase);
  • Push      notifications;
  • Application      performance monitoring; and
  • Personalization      and A/B testing.

Cookies are small files that can be used to track a user's steps or automatically generate a user's password. Some features of our Services may only be available through the use of a cookie. Among other things, cookies allow you to enter your password less frequently during a session. Cookies can also help us provide information which is targeted to your interests. Cookies are stored on your device, not on the Services. Most cookies are automatically deleted at the end of a session. 

When you interact with the Services, there are third parties that may also use automatic collection technologies to collect information about your or your device. These third parties may include advertisers, analytics companies, your device manufacturer and your internet or mobile service provider, among others.  You should be aware that we cannot control the use of cookies (or the resulting information) by our third-party partners or advertisers, or other third parties. You may decline cookies if your browser permits, although your use of the Services may then be restricted. 

D. Third Party Integrations 

The Services may integrate with third-party platforms such as:

  • Twilio;
  • AWS SES;
  • Google Firebase and other analytics      tools

Information collected by third parties that the Services may integrate with is governed by such third parties’ privacy policies. You should view the privacy policies of these third parties before providing information to them.

  

2. How We Use Your Information

We use your collected data to:

  • Operate      and improve the mobile application and other Services, and provide any      contents, features, information, products, or services that we make      available through the Services; 
  • Customize      your experience and feed content;
  • Facilitate      networking between athletes, trainers, and medical professionals;
  • Provide      customer support and send updates and notices; and
  • Ensure      legal compliance and monitor for abuse or fraud.

  

3. Disclosure of Your Information

We do not sell your personal data.  We may disclose aggregated information about our users[, and information that does not identify any individual,] without restriction. 

In addition, we may share personal information that we collect or you provide as follows:

· Service Providers: To contractors, service providers, and other third parties we use to support the Services These include, for example, hosting, analytics, authentication, support, fraud prevention and payment processing providers. These service providers are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them. Some of these third party service providers will collect information directly from you and provide us with relevant data (such as credit card processing companies). We may use this information to carry out our obligations and enforce our rights arising from any contracts entered into between you and us. 

· Business Transfers: To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Sidelined's assets or business, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about users of the Services is among the assets transferred.

  • Legal      Requirements: If required to comply with any court order, law, or legal      process, including to respond to any government or regulatory request, or      to carry out and enforce our obligations and enforce our rights arising      from any contracts entered into between us and users of the Services      (including our Terms and Conditions), and for billing and collection; or      if we believe disclosure is necessary or appropriate to protect the      rights, property, or safety of Sidelined, our customers, or others. This      includes exchanging information with other companies and organizations for      the purposes of fraud protection.
  • Notifications:      Notify users of the Services when Services updates are available and for      other communications relating to the Services; and
  • Other      Uses: To fulfill the purpose for which you provide it, for any other      purpose disclosed by us when you provide the information, or for any other      purpose with your consent. 

  

4. Your Rights & Choices

A. Access & Control

You can control certain uses and disclosures of your personal information through the mobile application settings. You can:

  • Update      or delete your profile information;
  • Change      visibility settings;
  • Opt      in/out of notifications ; and
  • Request      account deletion.

B. Your State Privacy Rights

Depending on your state of residency, you may have certain rights related to your personal data, including:

  • Access      and Data Portability. You may confirm whether we process your personal      data and access a copy of the personal data we process. To the extent      feasible and required by state law, depending on your state, data will be      provided in a portable format. Depending on your state, you may have the      right to receive additional information and it will be included in the      response to your access request.
  • Correction.      You may request that we correct inaccuracies in your personal data that we      maintain, taking into account the information's nature and processing      purpose.
  • Deletion.      You may request that we delete personal data about you that we maintain,      subject to certain exception under applicable law.
  • Opt      Out of Using Personal Data for Targeted Advertising, Profiling, and Sales.      You may request that we do not use your personal data for these purposes.

Important: The exact scope of these rights vary by state. There are also several exceptions where we may not have an obligation to fulfill your request

5. Data Security

We use commercially reasonable administrative, physical, and technical measures designed to protect your personal data from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. However, no mobile application, website, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal data transmitted to, though, using, or in connection with the Services. In particular, email, messages, [and chats] sent to or from the Services may not be secure, and you should carefully decide what personal information you send to us via such communications channels. Please use strong passwords and report any suspicious activity. Any transmission of personal information is at your own risk

  

6. Children’s Privacy

The Services are not intended for children under 13 . If you are a minor, please do not submit any personal information to the mobile application or any other services. We do not knowingly collect data from children under 13. If we learn we’ve collected personal information from a child, we will delete it promptly. If you believe we might have any information from or about a child under 13, please contact us at privacy@sidelined.US  .

  

7. Data Retention

We retain personal data for as long as necessary to:

  • Provide      our services and fulfill the purposes described herein;
  • Fulfill      legal and regulatory obligations;
  • Resolve      disputes and enforce agreements; and
  • Use      if necessary for safety, security, and fraud prevention.

This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain personal information. At the end of the retention period, personal information will be deleted, destroyed, or deidentified.

You may request account deletion via the mobile application settings or at privacy@sidelined.US  .

  

8. International Users

The owner of the Services is based in the State of New Jersey in the United States. We provide the Services for use only by persons located in the United States. We make no claims that the Services or any of their content is accessible or appropriate outside of the United States. Access to the Services may not be legal by certain persons or in certain countries. You should not access the Services from outside the United States. If you do, you do so on your own initiative and are responsible for compliance with local laws.

  

10. Changes to this Privacy Policy

We may update this Privacy Policy at any time. If required by applicable law or we make material changes, we will provide notice through the mobile application, [the Sidelined website] or other means. If you object to any of the changes, you may close your account. Continued use after the changes means you accept the updated Privacy Policy.
